Terms of Use, Commission Policy, Privacy, Complaints and Dispute Resolution

This package is shown to users when creating an account on the Lux Horse platform, and electronic acceptance of it is required to complete registration. By selecting "I agree to the Legal Package", the user acknowledges that they have read, understood and agreed to all the provisions set out below as a single, integrated and binding document, including the general provisions, the special provisions for each type of product or service, the Commission and Fees Policy, the Privacy and Personal Data Protection Policy, and the Complaints and Dispute Resolution Policy.

Consent Text at Account Creation

I acknowledge that I have read, understood and agree to the Lux Horse Unified Legal Package, including its Terms and Conditions, Commission and Fees Policy, Privacy and Data Protection Policy, and Complaints and Dispute Resolution Policy, and I agree to comply with them when using the platform.

First: General Terms and Conditions for Using the Lux Horse Platform

Welcome to Lux Horse, an online platform specialized in horses and equestrianism. It provides an online space that brings together horse enthusiasts, service providers, advertisers and buyers, covering the sale and purchase of horses, horse equipment and supplies, transport, boarding and training services, and any other services the platform may add in the future.

Using the platform, registering on it or publishing an advertisement through it constitutes acceptance of these Terms and Conditions and of the special terms of the section used by the user.

1. Definitions

Platform: the Lux Horse website and application and all related services.

Platform Management: [Luxy Horse], Commercial Registration No. [7054205484].

User: any natural or legal person who browses, registers on or uses the platform.

Advertiser: a user who publishes an advertisement for a horse, product or service.

Seller: a user who offers a horse or product for sale.

Buyer: a user who reaches a seller or an item for sale through the platform with the intention of purchasing.

Service Provider: a user who offers a transport, training, boarding or any other service.

Service Requester: a user who reaches a service provider through the platform.

Transaction: any sale or service provided between users as a result of reaching or being introduced to each other through Lux Horse.

2. Nature of Lux Horse's Business

Lux Horse is an online platform for intermediation and introduction between users.

The platform shall not, merely by publishing an advertisement, be deemed a seller or buyer of horses or supplies, a transporter, a trainer, or a provider of boarding services.

The platform does not become the owner or holder of the horses or products offered.

Any agreement relating to a sale or service is concluded directly between users, and each party bears its own obligations towards the other.

Lux Horse does not collect the price of horses or products or the fees for services on behalf of users, unless it expressly announces in the future a separate service that differs from the current intermediation model.

3. Account and Registration

Information provided at registration must be accurate, complete and up to date.

The user is responsible for keeping their account credentials confidential.

Impersonating others or using data the user is not entitled to use is not permitted.

The platform may request verification of the phone number, email address, identity or any other data necessary for security or regulatory compliance.

4. Use of the Platform

The user undertakes to use Lux Horse lawfully and in good faith.

Using the platform for fraud, deception, infringing the rights of others or publishing content that violates applicable regulations is prohibited.

Publishing prohibited or unlicensed goods or services is also prohibited where the activity requires a license.

5. Responsibility for Advertisement Content

The advertiser is responsible for the accuracy of the information, images, prices and data they publish.

The platform's acceptance of an advertisement for publication does not constitute an endorsement of its content or a guarantee of the reliability of the advertiser, product or service, except for matters the platform expressly declares it has verified.

6. Communication Between Users

The platform provides users with means to reach and communicate with each other.

The parties may then communicate, negotiate or reach an agreement on or off the platform.

Lux Horse does not become a party to any agreement merely because the initial contact took place through it.

7. Consideration and Commissions

Lux Horse may be entitled to a commission or fees for certain transactions arising through the platform in accordance with the published Commission Policy.

The applicable rate or fees are clearly disclosed to the user before any obligation to pay them arises.

8. Ratings and Reviews

Ratings and reviews must be genuine and related to the user's actual experience.

Using ratings to insult, slander or defame, or to publish false information or third parties' personal data without justification, is prohibited.

The platform may remove any infringing content.

9. Account Suspension

The platform may suspend or restrict an account in the event of a breach of these Terms, fraudulent use, inaccurate data, abuse of other users, or violation of applicable regulations.

10. Intellectual Property

All rights relating to the Lux Horse name, logo, design and software are reserved to their owners.

The user confirms that they hold the rights to the images and content they upload and grants the platform the permission necessary to display it, operate the advertisement and promote the platform.

11. Limitation of Liability

Lux Horse exercises reasonable care in operating the platform.

It does not guarantee the completion of transactions, the fulfilment of users' obligations, or the accuracy of all information provided by users.

It bears no responsibility for any price or amounts transferred directly between users.

These Terms shall not be construed as exempting the platform from any liability that cannot lawfully be excluded.

12. Special Terms

Each section of Lux Horse has special terms that form an integral part of these Terms.

In the event of a conflict relating to a particular service or section, the special terms of that section shall prevail within the scope of their subject matter.

13. Governing Law

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.

Disputes shall be settled before the competent authority in accordance with the applicable rules of jurisdiction.

Second: Provisions for Buying and Selling Horses

1. Capacity of the Platform

Lux Horse is an online intermediary that allows horse owners to list their horses and interested parties to reach them.

The platform does not own the listed horses, does not sell them on its own account, and is not a guarantor for either the seller or the buyer.

2. Seller's Obligations

The seller confirms that they are the owner of the horse or are legally authorized to sell it.

The seller undertakes to provide accurate information about the horse, including, where applicable:

Sex, age, breed, color, location, registration or identification details, pedigree where advertised, experience or use, health condition, and any material information relating to the horse.

The seller undertakes to disclose any diseases, injuries or material defects known to them that may affect the purchase decision.

3. Images and Documents

The seller is responsible for the accuracy of the images, documents, certificates and data they publish or provide to the buyer.

Their presence on Lux Horse does not constitute confirmation by the platform of their accuracy.

4. Buyer's Obligations

The buyer must ensure the horse is suitable for their purpose and carry out whatever inspections and examinations they deem appropriate before purchase.

The advertisement alone should not be relied upon for decisions that require specialist examination.

5. Veterinary Examination

The buyer may agree with the seller to carry out an independent veterinary examination before completing the sale.

The parties shall determine who performs the examination and who bears its cost.

The buyer's decision not to have an examination carried out shall not be deemed a guarantee by Lux Horse of the horse's health condition.

6. Price

The seller sets the price, and the parties may negotiate and agree on a different final price.

The final price is a matter between the seller and the buyer.

7. Payment of the Price

The buyer pays the price of the horse directly to the seller using the method agreed between them.

Lux Horse does not receive, hold or transfer the price of the horse to the seller.

8. Commission

If a purchase is made as a result of the buyer reaching the horse or the seller through Lux Horse, the platform is entitled to the announced commission in accordance with the Commission Policy.

Entitlement to the commission is not forfeited merely because the final agreement or payment of the horse's price took place outside the platform.

9. Transport and Delivery

The parties shall agree on the place and time of delivery and on who bears the transport costs.

Lux Horse is not responsible for transport unless it expressly declares that it is the transport service provider in a particular case.

10. Diseases and Defects

The seller's liability for fraud, deception, inaccurate information or concealment of material defects remains subject to the agreement and applicable regulations.

11. Regulatory Requirements

Users shall comply with registration, transport, veterinary health and other regulatory requirements applicable to horses according to the nature of the transaction.

Third: Provisions for Buying and Selling Horse Supplies

These terms apply to saddles, bridles, apparel, equipment, tools and other horse supplies offered through Lux Horse.

1. Seller's Responsibility

The seller must be the owner of the product or authorized to sell it.

The product must be accurately described, including its condition, whether it is new or used, and any known material defects.

2. Genuine and Counterfeit Products

Offering counterfeit products as genuine, or using trademarks in a misleading manner or in violation of intellectual property rights, is prohibited.

3. Price

The published price is the price requested by the seller, unless it is marked as negotiable.

The final price agreement is between the two parties.

4. Payment

The price of the product is paid directly by the buyer to the seller.

Lux Horse does not receive the value of the product.

5. Delivery and Shipping

The parties shall agree on the delivery or shipping method and its costs.

Lux Horse is not a shipping company merely by making the advertisement available.

6. Inspection

The buyer is advised to inspect the product and verify its condition and suitability before completing the transaction whenever possible.

7. Returns

Return or exchange rights are subject to the nature of the seller and the transaction and to the mandatory applicable regulations, and these terms shall not be construed as waiving any statutory right that cannot be waived.

8. Commission

The commission announced on the platform is due whenever the transaction is one that is subject to commission under the Lux Horse policy.

Fourth: Provisions for Horse Transport Services

1. Nature of the Service

Lux Horse allows horse transport service providers to list their services and horse owners to contact them.

Lux Horse is not a horse transporter merely by publishing a transport advertisement.

2. Transport Provider's Obligations

The service provider is responsible for the accuracy of information relating to the service, vehicle, geographical coverage, price and available services.

The provider is also responsible for obtaining any licenses, permits or requirements necessary for their activity where applicable.

3. Vehicle Condition

The transport provider is responsible for the roadworthiness and safety of the vehicle and equipment used for transport in accordance with the requirements applicable to their activity.

4. Horse Information

The service requester undertakes to provide the necessary information about the horse that affects the transport, including any material health or behavioral condition known to them.

5. Pick-up and Delivery Times

The time, location, route and price are agreed directly between the service provider and the service requester.

6. Payment

Transport fees are paid directly to the service provider and are not received by Lux Horse unless otherwise announced in the future.

7. Insurance

If the advertisement or the service provider mentions insurance coverage, the user must verify the existence of the insurance policy, its scope, exclusions and compensation limits.

Lux Horse is not an insurance company and does not guarantee the existence or adequacy of insurance coverage unless it expressly declares otherwise.

8. Transport Liability

Responsibility for the safekeeping and care of the horse during transport lies with the service provider within the limits set by the agreement and applicable regulations.

9. Platform Commission or Fees

If the transport service is subject to Lux Horse fees or commission, these will be clearly shown to the user before any obligation to pay them arises.

Fifth: Provisions for Horse Boarding Services

1. Nature of the Service

Lux Horse allows stables, horse yards and boarding service providers to list their services and communicate with horse owners.

Lux Horse is not the boarding provider merely by publishing the advertisement.

2. Boarding Provider Information

The service provider undertakes to accurately disclose the boarding location, services, price, nature of the facilities and any material conditions.

3. Horse Condition

The horse owner undertakes to disclose any material health or behavioral information that may affect the safety of the horse, other horses or staff.

4. Included Services

The parties must agree on what the boarding price includes, such as feeding, cleaning, exercise, care and additional services.

5. Veterinary Care and Emergencies

It is recommended to agree in advance on how to handle veterinary emergencies, who is entitled to make decisions when the owner cannot be reached, and who bears the cost.

6. Fees

Boarding fees are paid directly by the service requester to the service provider.

7. Injuries

The boarding provider's liability for injuries or damage is determined according to their cause, the agreement and applicable regulations, and Lux Horse bears no liability for the acts of the boarding provider merely because it was listed through the platform.

8. Boarding Period

The parties agree directly on the boarding period, renewal, termination and the date for collecting the horse.

9. Lux Horse Fees

The service is subject to any fees announced by Lux Horse in accordance with the Commission and Fees Policy.

Sixth: Provisions for Horse Training Services

1. Nature of the Service

Lux Horse allows trainers and training centers to list their services.

Lux Horse is not a trainer or training body merely by displaying the advertisement.

2. Trainer Information

The training provider is responsible for the accuracy of any statements about their experience, qualifications and services.

3. Training Program

The horse owner and the trainer agree directly on the type of training, its objectives, duration, location and price.

4. Horse Condition

The horse owner undertakes to inform the trainer of any material health or behavioral condition known to them.

5. Inherent Risks

The user understands that handling and training horses may inherently involve risks; this does not exempt the training provider from liability arising from misconduct, negligence or violation of applicable regulations.

6. Results

The training provider does not guarantee any specific sporting or behavioral outcome unless they provide an express and lawful guarantee regarding a specific matter.

7. Injuries and Treatment

It is recommended to agree in advance on how to handle injuries or the need for veterinary treatment.

8. Fees

Training fees are paid directly to the trainer or training center.

9. Lux Horse Fees

The service is subject to the fees announced by Lux Horse, if any.

Seventh: Commission and Fees Policy

1. Commission Principle

Lux Horse is entitled to consideration for its online intermediation service in the categories the platform announces as subject to commission.

2. Party Responsible for the Commission

In sales transactions that the platform announces as subject to commission, the commission is payable by the buyer, unless a different arrangement is clearly shown to them before the transaction.

3. Commission Rates

Horse sales: (4%) of the final sale value.

Supplies sales: (4%) or as announced by the platform.

Transport services: [4% / fixed fee / no fee].

Boarding services: [4% / fixed fee / no fee].

Training services: [4% / fixed fee / no fee].

No rate that has not been disclosed to the user shall be payable.

4. When the Commission Becomes Due

In sales transactions, the commission becomes due upon completion of the sale if the buyer reached the seller or the item through Lux Horse.

5. Transactions Completed Outside the Platform

Entitlement to the commission is not forfeited because communication, negotiation or payment moved outside Lux Horse, provided that the initial contact with the seller or item took place through the platform.

6. Nature of the Obligation

Once due, the commission constitutes a financial obligation owed by the user to Lux Horse at the rate announced at the time of the transaction.

Lux Horse relies on the user's commitment and honesty in paying the commission due.

The platform is not required to monitor transfers, prove each transaction, or intervene in the financial relationship between the seller and the buyer.

7. Transaction Price

The commission is separate from the price of the product or horse or the service fee.

Lux Horse does not receive the sale price on behalf of the seller.

8. Commission Value

The commission is calculated on the actual final transaction value agreed between the seller and the buyer.

9. Taxes

Value Added Tax or any other taxes apply to the Lux Horse commission as required by applicable regulations, and this will be shown to the user through the approved mechanism.

10. Rate Changes

Lux Horse may change commission rates for future transactions, provided that the new rate is announced before any obligation arises for the user.

Any change shall not affect the commission on a transaction that became due under a previously announced rate.

Eighth: Privacy and Personal Data Protection Policy

1. Introduction

Lux Horse respects the privacy of its users and handles personal data in accordance with the regulations in force in the Kingdom of Saudi Arabia.

2. Data We May Collect

Depending on the use of the service, data may include:

Name, phone number, email address, account data, location or city, advertisement content, images, support messages, device and usage data, and other data provided voluntarily by the user or required to provide the service.

3. Purposes of Processing

Data is used for purposes related to operating the platform, including:

Creating accounts, publishing advertisements, enabling communication, providing support, improving the service, combating fraud, protecting users, and fulfilling regulatory obligations.

4. Data Minimization

Lux Horse seeks to collect only the data necessary to achieve the purposes of processing and to avoid collecting data the service does not need.

5. Data Sharing

Data may be shared to the extent necessary with technical service providers or parties engaged by Lux Horse to operate the platform, or where disclosure is required or permitted by law.

Lux Horse does not sell personal data for the purpose of generating revenue from the sale of data.

6. Visibility of Advertiser Data

The advertiser understands that some contact details, location or information they choose to publish may be visible to users depending on the design of the service.

The advertiser should therefore not publish information they do not wish to make public.

7. Storage and Protection

Lux Horse takes appropriate organizational and technical measures to protect data according to its nature.

Data is retained for the period necessary to achieve the purpose or fulfil a regulatory obligation, and is then handled in accordance with applicable requirements.

8. Data Subject Rights

Data subjects enjoy the rights established by the Personal Data Protection Law and its regulations, subject to the conditions and circumstances for exercising each right.

9. Privacy Requests

Ninth: Complaints and Dispute Resolution Policy

2. Complaint Details

A complaint should include sufficient information to understand the issue, including the user's details, the advertisement or service number, and a description of the problem.

3. Disputes Between Users

If the dispute relates to a sale or service contract concluded directly between users, Lux Horse may facilitate communication between them without becoming a party to the dispute.

4. Complaints About the Platform

Lux Horse reviews complaints relating to its services and takes appropriate action according to the nature of the complaint.

5. Infringing Content

The platform may suspend an advertisement or account while verifying a serious report relating to fraud, violation of regulations or user safety.

6. Amicable Settlement

Lux Horse encourages the parties to attempt to resolve disputes amicably where appropriate, without prejudice to any party's right to refer the matter to the competent authority.

7. The Platform Has No Judicial Role

Lux Horse is not an arbitration or judicial body and has no power to compel a user to refund an amount or pay compensation to another party, unless the obligation relates to a service provided by Lux Horse itself.

8. Competent Authorities

This policy does not prevent any user from filing a report or complaint with a competent governmental or judicial authority where they are entitled to do so.

Final Provisions on Electronic Consent

The user's electronic consent at account creation constitutes acceptance of the Unified Legal Package in the version in force at the time of consent. The platform may update the package when necessary, and users will be notified of material changes where required; users may be asked to renew their consent depending on the nature of the amendment and regulatory requirements. Combining these provisions into a single document does not affect the specific provisions relating to each category of sale or service; the provisions of the category used by the user apply alongside the general provisions and the other relevant policies.
